INFORMATION OBLIGATION AS REGARDS PROTECTION OF PERSONAL DATA

     
I.      ADMINISTRATOR OF PERSONAL DATA
„Drozapol-Profil” S.A. with a seat in Bydgoszcz at Toruńska 298a is the administrator of personal data.

II.      PROCESSED PERSONAL DATA
We process personal data in connection with:
   1. SELLING AND PURCHASING OF STEELWORKS GOODS AND PRODUCTS
   We are a distributor of steelworks products and a manufacturer of construction reinforcement elements, we cooperate with other manufacturers or distributors. 
   Subjects that the data concern: contractors, potential contractor as well as their employees and persons cooperating with them. 
   Processed data:  first names, surnames, professional details, contact details, addresses, banking account numbers, registration and identifying details (e.g. PESEL no, ID no). If sales is connected with transport, additional information such as vehicle registration numbers, driver's ID or passport no as well as driver's driving licence's no. 
   Basis and aim of data processing:
      1) concluding and completing of an agreement;
      2) meeting of imposed legal obligations such as, for example:
            a) storing data for the sake of future proceedings by authorized state institutions;
            b) submitting and resolving of complaints;
            c) paying of public and legal fees, levies, etc.
      3) Justified public interest:
            a) documenting completing of a transaction;
            b) establishing, defending and seeking one's claims;
            c) direct marketing;
            d) making elaborations, analysis and statistics, including those of sales and turnover, for internal purposes;
            e) verifying of a contractor's paying credibility;
            f) filing purposes.
   2. PROVIDING OF TRANSPORT SERVICES
   We provide transport services. 
   Subjects that the data concern: contractors, potential contractor as well as their employees and persons cooperating with them. 
   Processed data:  first names, surnames, professional details, contact details, addresses, banking account numbers, registration and identifying details, vehicle registration numbers, driver's ID or passport no as well as driver's driving licence's no. 
   Basis and aim of data processing:
      1) concluding and completing of an agreement;
      2) meeting of imposed legal obligations such as, for example:
            a)storing data for the sake of future proceedings by authorized state institutions;
            b)submitting and resolving of complaints;
            c)paying of public and legal fees, levies, etc.
      3) Justified public interest:
            a)documenting completing of a transaction;
            b)establishing, defending and seeking one's claims;
            c)direct marketing;
            d)making elaborations, analysis and statistics for internal purposes;
            e)verifying of a contractor's paying credibility;
            f)filing purposes.
   3. INVESTMENT ACTIVITIES
   We carry out investment activities of buying and selling real properties and movable properties as well as carrying out activiites of their paid renting.
   Subjects that the data concern: contractors, potential contractor as well as their employees and persons cooperating with them.
   Processed data:  first names, surnames, professional details, contact details, addresses, banking account numbers, registration and identifying details;
   Basis and aim of data processing:
      1) concluding and completing of an agreement;
      2) meeting of imposed legal obligations such as, for example:
            a)storing data for the sake of future proceedings by authorized state institutions;
            b)submitting and resolving of complaints;
            c)paying of public and legal fees, levies, etc.
      3) Justified public interest:
            a)documenting completing of a transaction;
            b)establishing, defending and seeking one's claims;
            c)direct marketing;
            d)making elaborations, analysis and statistics for internal purposes;
            e)verifying of a contractor's paying credibility;
            f)filing purposes.
  4. RECRUITMENT PURPOSES
   We conduct recruitment of employees and collaborators. 
   Subjects that the data concern: persons applying for employment.
   Processed data: personal data made available by a person being recruitted or an employment agency such as: first name and surname, date of birth, information on education, so far employment, professional licences and qualifications.
   Personal data within the recruitment process are gained according to a consent granted. The person who has granted such consent has the right to withdraw it at any time no matter what so far law on processing was.
   Basis and aim of data processing:
      1) consent;
      2) concluding and completing of an agreement;
      3) meeting of imposed legal obligations, for example:
            a)storing data for the sake of future proceedings by authorized state institutions;
            b)paying of public and legal fees, levies, etc.
      4) Justified public interest:
            a)recruitment procedure;
            b)establishing, defending and seeking one's claims;
            c)making elaborations, analysis and statistics, including those of sales and turnover, for intenal
            d)filing purposes.
   5. CONDUCTING ENTERPRISE/COMPANY
   We process personal data within the process of everyday running of our company.
   Subjects that the data concern: subjects contacting the company as well as their employees and collaborators, shareholders holding personal shares and persons staying within our premises and buildings in connection with visual monitoring.
   Processed data:  first names, surnames, professional details, contact details, addresses, registration and identifying details, registration numbers of vehicles entering our premises as well as images from visual monitoring.
   Basis and aim of data processing:
      1) concluding and completing of an agreement;
      2) meeting of imposed legal obligations such as, for example:
            a)storing data for the sake of future proceedings by authorized state institutions;
            b)submitting and resolving of complaints;
            c)paying of public and legal fees, levies, etc.;
            d)investor's relations;
            e)conducting shares' book;
      3) Justified public interest:
            a)documenting activities;
            b)establishing, defending and seeking one's claims;
            c)direct marketing;
            d)making elaborations, analysis and statistics for internal purposes;
            e)verifying of a contractor's paying credibility;
            f)filing purposes.
            g)preventing and revealing of crimes (caring for safety).

 

III.      ORIGIN OF PERSONAL DATA
Processed personal data are transferred to us directly by persons to whom such data pertain or from other data aministrators that we cooperate with or from publicly available sources.

 

IV.      NO OBLIGATION TO PROVIDE DATA
As a rule, providing personal data is voluntary, it may however form a condition of concluding an agreement.

 

V.      RECIPIENTS OF PERSONAL DATA
We may transfer processed personal data, including those provided by authorized persons, to:
      1. Subjects processing data on our behalf:
            a) subjects being agents in transactions made by us;
            b) sub-contractors;
            c) subjects providing counselling services, consulting services, auditting services, IT services, legal services, tax services, accountancy services, research agencies acting when authorized by us;
      2. other administrators processing data on their own behalf whose participation is necessary to complete a certain process such as, for example:
            a) other parties of a transaction;
            b) transporting companies;
            c) forwarders;
            d) customs agencies;
            e) insurers;
            f) state or self-government bodies;
            g) courts of law;
            h) law enforcers;
            i) economic infomation bureaux;
            j) post operators and couriers;
            k) banks;
            l) subjects cooperating with us with providing accountancy, fiscal, legal services - within the scope in which they become such data administrators;
            m) subjects forming Drozapol-Profil S.A. Capital Group Invest Sp. z o.o., DP Wind 1 sp. z o.o.

 

VI.      PERIOD OF RETAINING DATA
We process data for the time necessary to achieve the aim of such processing. After completing it, we file personal data in accordance with current law regulations in force. Due to the statutory periods of civil-legal and public-legal claims becoming invalid, personal data are removed after the period of 10 years counting from the end of the year when the aim of their procesing was completed.

 

VII.      OBJECTING TO DIRECT MARKETING
A person whose personal data are processed within the direct marketing programme enjoys a right to object to having her/his personal data processed for such marketing purposes that s/he may express at:

VIII.      AUTOMATION OF DECISION TAKING
We do not make decision based exlusively on automated processing, including profiling of personal data.

 

IX.      TRANSFERRING PERSONAL DATA OUTSIDE THE EUROPEAN ECONOMIC AREA
In case there is a need to conclude a transaction with a contractor from outside the European Economic Area, it may be necessary to transfer personal data outside  such European Economic Area.
We may transfer data of drivers or employees of subjects taking part in a transaction.
As a rule, transferring data outside the European Economic Area shall take place according to standard agreed provisions, whose content was approved by the European Commission.

 

X.      RIGHTS OF PERSONS WHOSE DATA ARE PROCESSED
Persons whom such data concern have the right to:
      1) correction (changing) of data according to rules and within the scope as prescribed by art. 16 GDPR;
      2) removal of data according to rules and within the scope as prescribed by art. 17 GDPR;
      3) limitation of data processing (stopping the operation on data or their removal - in line with filed application) according to rules and within the scope as prescribed by art. 18 GDPR;
      4) access to data (applying for infomation on data processed by us and their copy) according to rules and within the scope as prescribed by art. 15 GDPR;
      5) transfer of data according to rules and within the scope as prescribed by art. 20 GDPR
      6) filing an objection to their personal data being processed by us (including profiling), if the basis of making use of such data is legally justified interest according to rules and within the scope as prescribed by art. 21 GDPR;
When one wants to use one of the above rights, one should send a relevant demand application indicating the scope of data that are the object of such demand at the email address:
rodo@drozapol.pl or by post at the address provided below.
When protecting one's data against unauthorized access, one may demand an additional identification of a person whom such data concern or additional infomation.
Possibility of making use of any of the above rights results from current law regulations in force, i.e. depends on the legal basis and aim of data processing.

 

XI.      COMPLAINT TO A SUPERVISING BODY
A person whom data concern enjoys a right to file a complaint with the supervising body as regards the scope of his/her personal data processing in a way indicated at the address:
www.giodo.gov.pl.
